Minister wants ombudsman for ‘contentious’ adoptions

Children's minister Tim Loughton is considering whether "highly contentious" adoption cases should be investigated by a government-appointed ombudsman, Community Care can reveal.






As the government launched updated guidance designed to improve adoption rates for children in care, Loughton told Community Care he was also concerned about any case where a child is wrongly removed from its parents and placed for adoption.






Loughton said he was aware of a minority of "very questionable judgements" made by courts, before revealing that he is contemplating "some sort of ombudsman system" to investigate highly contentious cases, in the hope of finding solutions.






"There is a lot of work to do to make sure we have more adopters and swifter, better quality adoption placements, but there is also work needed to make sure that the small number of cases which go horribly wrong, and are difficult to justify, are tackled as well so that people feel the adoption system is doing the right thing for children," he said.






Currently there is no such inspection framework for family law cases, but Community Care understands the changes could be considered as part of wider family court reforms the government is looking to make, through the ongoing Family Justice Review.


Loughton also hit out at the family courts system for being "too process-driven", which, he said, was leading to delays in decision-making for children.






"I think the courts are too process-driven. There are some cases where very clearly there is no way back to a child's birth parents and the child is a strong candidate for adoption. Do we need to go through quite as many processes for that child as for another where it is not such a clear cut decision? I think we can use a more proportionate approach in many cases."






Loughton said he is trying to encourage local judges and adoption panels to discuss areas of "huge disconnect" before any new guidance for the family courts is contemplated.






"Whenever I speak to adoption services and adoption panels they say their job is being made harder because of court processes and delays: in getting the hearing; in the fact that judges are always asking for that extra expert witness statement and so forth.






"Then I speak to judges and they say adoption panels are taking so long to process paperwork, hold meetings and bring cases back to court. There just seems to be a huge disconnect at the moment."






"If we have better communication we might find that we can streamline the system better before we have to bring in any new guidance. We've got to make sure that both sides, judges and adoption panels and social workers, are talking to each other. Then we can look at ways to make adoption panels more effective and ways that judges can do their job more effectively."






Loughton said he hoped the family justice review, due to publish its interim report at the end of March, would provide "strong steers and advice" and lead to "greater transparency in the family courts".

Hi,

it is clear that the VBS & CRB system is inadequate and in fact dangerous.

One only needs to note the number of sick paedophiles that have gained access to children despite the system and there is also no way to prevent the sick maliciously alleging individuals are either victims or claiming people are perpetrators with little recourse.

The entire structure requires revamping and strengthening to protect both children and the victims of perverts who derive pleasure in abuse by making accusations without a shred of valid admissible evidence, as with the likes of Anne Greig, David Icke, Matt Quinn, Steven Milne, Ian McFerran, Robert Green and their ilk.

Labour’s much criticised Vetting and Barring Scheme (VBS) will no longer go ahead, with the vetting of individuals “very significantly” curtailed.


Only those in sensitive posts or who have intensive contact with children or vulnerable people will need to be cleared and undergo criminal record checks.


Instead of millions having to register themselves with the Independent Safeguarding Authority (ISA), which would conduct criminal record checks and oversee a national database, the onus will shift to the employer to ensure staff are properly checked and cleared to work.


The number of people affected is expected to more than halve.


In a related move, criminal record checks will no longer be sent directly to potential employers but to the individual first to allow them to challenge any concerns or suspected errors.


New rules will also pave the way for minor offences in the past to no longer be included in checks.


The Coalition pledged to restore vetting to “common sense” levels.


The reform, to be included in the Freedom Bill published next week, aims to reverse the notion that everyone is a potential risk to children.


A Whitehall source said the proposals would result in a “very significant scaling back” of the vetting scheme.


“It will tread a sensible line between, on the one hand, making sure that sensible people, volunteers and everyone, are not let down by this ridiculous, bureaucratic system and on the other hand protecting children and passing the 'school caretaker test’.”


The VBS was set up in the wake of the Soham murders. Ian Huntley was given a job as a school caretaker after checks failed to pick up sex-related allegations.


The scheme was to have taken effect last autumn but was halted by the Coaltion pending a review. The VBS will not go entirely, but will be dramatically reduced and is likely to be renamed.


The £80 million ISA will be merged with the Criminal Records Bureau into a single organisation responsible for checking people’s backgrounds and clearing them for work.

Four couples took over a quiet cul-de-sac in rural Wales and set-up a sex cult after moving from London, a jury heard.


Leader Colin Batley, 48, allegedly used four women to find him victims while organising three-in-a-bed sex sessions.


He used his position to rape both boys and girls, to make children engage in intercourse together and to persuade the women to join in, the court was told.

The grey-haired man, described as ‘evil and manipulative’, was allegedly a sexual predator who used others to do his bidding.


Batley even persuaded three women to get identical tattoos to show their membership of the cult in the seaside village of Kidwelly, near Carmarthen, the jury at Swansea Crown Court heard.


Peter Murphy, prosecuting, said Batley held regular meetings of the 'quasi-religious cult' where he preached from a text called The Book of the Law and warned of dire consequences if the women did not do as told.


He said: 'He (Batley) is the principal. The four families became closely intertwined, that is common ground. It became much more than that, a cult.


'The usual restraints went out of the window. Some took part in wife swapping.’


In 1995 Sandra Iveson, 49, moved into the quiet street before the others moved in over the next four years.

Defendants Batley and his wife Elaine, 47, Jacqueline Marling, 42, and 35-year-old Shelly Millar all got properties in the street.


Mr Murphy said one teenage girl would tell the court later how she attended a Halloween party and saw two women performing oral sex on two men.


A teenage boy would say he had a 'threesome' with Elaine Batley and Jacqueline Marling, and intercourse with Shelly Millar, all before he was 16.


Batley and Marling admitted having sex with the youth but claimed it had been a 16th birthday present, the prosecutor said. Millar denied ever having sexual intercourse with him.


Another girl allegedly had a threesome with Colin Batley and Jacqueline Marling.


On a separate occasion Batley made a 16-year-girl have sex with a boy of 15 while Marling filmed it on a camcorder, it was alleged.


Mr Murphy said in 2000 Colin Batley travelled to Bedfordshire to advise the daughter of a cult member about her marital problems, and had sexual intercourse with her before returning to Wales.


The five defendants deny a total of 33 charges, including rape, indecent assault, forcing a girl to work as a prostitute and inciting a child to have sex.


A sixth defendant, 70-year-old Vincent Barden, from Kempston, Bedfordshire, has admitted twice indecently assaulting an underage girl but denies rape.


The trial continues.

A predatory paedophile - dubbed 'Al the Paedo' by work colleagues - was jailed for ten years today after he filmed himself repeatedly abusing two young girls and hoarding 200,000 indecent images of children.


Alan Potbury, 38, carried out sickening sexual abuse on two six-year-old girls over a period of three years - attacking one victim he babysat for after befriending her parents.


Former deliveryman Potbury took pictures and filmed his horrifying sexual crimes on a mobile phone before downloading the footage onto his computer.


He was finally caught when the mother of one of his victims saw her daughter kissing her brother and explained that Potbury had shown her how to do it.


Police raided his home in Weston-super-Mare, Somerset, and uncovered almost 200,000 indecent images and movies stashed on mobile phones, DVDs and his computer.


Potbury admitted a total of 35 counts at Bristol Crown Court, including seven counts of assault on a child under 13 and five of sexual assault on a child.


He also confessed to 12 counts of taking photographs or movies of the abuse, as well eleven other counts of downloading thousands of child porn images and movies from the internet.


Jailing him for ten years, Judge Neil Ford QC told Potbury his catalogue of abuse had been a 'flagrant and dreadful breach of trust'.


'As they are young children it is impossible to presently assess the damage you have done to their development. But your activity is something they will have to deal with when they have an understanding of these matters. It was a significant ordeal for them.


'I have read the impact statement from the parents and they say they have lost trust in humanity and talk of their self blame, although that's not warranted, and their anger.

'The other victim's mother talks of anger, loss of trust and self blame. Again in her case it obviously was not her fault but that is of little comfort to her.


'Your behaviour demonstrated you have an attraction to young children, indeed very young children, which you find it difficult to control. Your offences constituted a dreadful breach of trust and the fact was that you took the opportunity to make explicit records, including movies, of your activities.


Bristol Crown Court heard Potbury was known by work colleagues as 'Al the Paedo' because of his crude and sexual comments about children and women when he made home deliveries.


The court heard bespectacled Potbury, who stared straight ahead throughout the two-hour hearing, had received a caution for indecently assaulting a girl under the age of 16 in 1993, while he babysat for her.


James Ward, prosecuting, said it was the Crown's case that 1993 was the start of a period in Alan Potbury's life that culminated in him abusing the two young girls.


Mr Ward said: 'Alan Potbury came into the friendship circle of the household. As the friendship got stronger they would see him at least once a month - then once or twice a week.


'The victim's mother says she thought nothing of it and that Alan would often stay over on the sofa.' Potbury's babysitting duties became more frequent in 2010 when the girl's mother started an evening course and her husband left the marital home.


Mr Ward told the court: 'The victim's mother says Alan would quite regularly read the child a bed time story or help bath her other two children.'


Police found images and movies - complete with times and dates - of him abusing the youngsters at his home in Weston-super-Mare, Somerset. They also found near identical images and videos of him attacking another six-year-old girl back in 2007.


The footage had been burned onto DVDs and downloaded onto Potbury's computer.


Officers also found a total of 190,031 other indecent images that the defendant had downloaded onto his machine from the internet between 2001 and 2010.


Of those abuse pictures, 121 were level five - the most serious abuse category there is. Over 100 child porn movies were also discovered - of which four were categorised as level five.


A statement read out by the prosecution on behalf of the devastated father of one of the victims accused Potbury of preying on his family - just so he could get his hands on his daughter.


He said: 'I now firmly believe that Alan Potbury got close to my family to get close to my children. I thought it was my wife who he was interested in and not my children.'


Police also investigated Potbury's other hobby - as a volunteer for the coastguard - but the court was told there was no evidence of offending. Derek Perry, defending Potbury, said he accepted his client could be facing a lengthy jail term and said he could not deny the crimes were 'reprehensible'.


He claimed Potbury had suffered from Klinefelter's syndrome - a sex chromosome disorder which meant he grew a breast as a teenager.


Mr Perry told the court that after having the breast removed, and being rendered infertile, his client suffered depression which may have driven him to commit the offences.


He also stressed that Potbury vehemently denied he had targeted women or families with young children.


As well as ten years in prison, Potbury was also ordered to sign the Sex Offenders Register for life and the material he collected was ordered to be destroyed.
